Self Defense Laws E-mail
Self defense involves being able to incorporate various tactics to protect yourself. This can be using your body or a variety of different weapons designed specifically for such purposes. There are some laws surrounding self defense that you should familiarize yourself with. Otherwise you could end up participating in acts that can get you into trouble with the law.

In once instance a blind man with a martial arts background was approached by someone who had made a lifelong career out of robbing other people. He quickly learned he had picked the wrong individual to rob on this particular day though. The man was able to flip the robber over his back and onto the ground. The robber died from this as the result of a broken neck.

The blind man soon found himself in the middle of a frenzy. While he could have been charged with various criminal and civil statutes he never was because it was believed he acted strictly out of self defense. Had his actions not been provoked by the robber then they would never have taken place. However incidents like this take place all the time in the United States. Some of the victims soon find themselves sharing a cell with the same type of criminal that approached them in the first place.

The laws on self defense are often left open to interpretation though and that is what results in victims finding themselves on one side or the other of the law after the ordeal has taken place. The laws state self defense can only be introduced when the individual feels their life or the life of others is in immediate danger. The amount of force used to control the situation has to be reasonable as well.

In most instances the decision to pursue charges or to consider the act self defense depends on the laws in the jurisdiction where they incident took place. This is important because the laws where you were at the time of the incident may be very different than those in the town you reside in.

Many states take a look at each one of these cases on an individual basis. They look at the information of what a reasonable person would do in such as situation. However even this can be an area where you can't always be objective. Let's take a look at the example above again.

How do you judge such a situation? If you say it isn't reasonable that a person would be able to flip the robber over their shoulder and cause them to break their neck then the victim may be viewed as a criminal. However, if you view the situation as a person with martial arts training would reasonably react the same way in a similar situation then the actions fall into the category of self defense.

Another area that is looked at is the issue of deadly force. In the instance of the blind man again he did not use excessive force. It was an act of nature that the robber landed the way he did. However if you repeatedly shoot someone or your beat them to prevent them from taking an action against you it may be considered excessive force. The question that remains to be answered though is how much force is enough to protect yourself and how much is excessive?

While there are laws in place relating to self defense the majority of them are very vague and open to interpretation. This makes such laws very complex to decipher, especially in a court of law. The way such laws are interrupted can vary by state and even by court. If you find yourself dealing with such a situation you need to place your future into the hands of a well qualified attorney who specializes in the area of self defense.
