There are several reasons for this, the major reason being The Data Protection Act in Canada that limits the access to any personal information requested by third parties. Although Canada has its criminal databases maintained in fairly the same manner as the United States i.e. on a National, Provincial and the local level accessing information from these sources is almost next to impossible task. Whereas the United States has its NCIC, Canada has its own Information Data Bank that stores the majority of the criminal activity records. But access to this data by third parties is prohibited by the law unless you have express written permission from the individual concerned. Further there is no way to request information over the internet, by fax or by phone. It is mandatory to make requests in person at the local Royal Canadian Mounted Police divisions. The request has to be accompanied with an official Consent for Disclosure of Criminal Record Information (RCMP form GRC 3584 eng.) form that has been signed by the applicant, and a copy of two pieces of photo identification from the applicant, a third party upon providing proper identification can obtain a criminal background check from any Royal Canadian Mounted Police divisions. Another method of performing background checks in Canada is from the Security Clearance Unit of the Provincial Police Departments. The procedure for acquiring information from here is also quite complicated and required a fingerprint card. Again, an individual may request that the information is released to a third party. The third method of performing background checks in Canada is to search local court records. Courthouse searches only cover cases filed in the jurisdiction that is being searched. From court to court, policies vary as to the how long records are retained, and the level of access provided. The fourth method of performing background checks in Canada is through the municipal police departments which can provide employee background checks with, or at times even without, a release from the individual. But this might not be in compliance with the Data Protection Act. Performing background checks in Canada can be a time consuming process, therefore it is imperative for the employers to consider how long, they are willing to wait for the results and how in depth information they want. The process can sometimes get frustrating for the applicant if he has to obtain a fingerprint card and provide the employer will all the required documents. All of the factors must be taken into consideration when determining which pre employment screening method best suits a particular employer. |
