A firearms criminal background check seems like a perfectly acceptable law that most would believe is upheld throughout the United States. Technically, there are more than 2 million guns in the hands of average citizens in the United States and many of those in possession of a firearm have not passed any kind of gun criminal background check. There are several states, including Virginia, California, Texas, and Arizona that do not require the same firearm background check be performed if the gun is purchased at a gun show.
A handgun background check is designed to help keep guns out of the hands of criminals and those who are considered mentally ill to the point of potential violence.
Yet an individual who has failed to pass a firearms background check can attend an open air gun show and purchase a hand gun, rifle, or semi or automatic weapon often without showing any form of ID. Open air dealers, who are often not licensed, will often charge an additional $50 t $100 to skirt around the need for ID before making a weaponry purchase.
A firearm background check is not intended to interfere with one's right to bear arms but it is a safety factor implemented to restrict the purchase of guns by those who have lost their right to bear arms via their own previous behaviors. If a gun dealer sells a gun without a handgun background check, the penalties are very steep. However, if that same gun dealer attended an open air gun show and sold a firearm to someone without the benefit of a gun background check, even if the resident comes from another state, there are no penalties because this is perfectly legal. In some cases, underage kids have been able to obtain firearms without age verification or a
gun criminal background check and thus, incidents of school and college campus violence have increased significantly.
There is legislation in the works to tighten up the deals that are performed at open air markets. Many open air gun shows hold over ten thousand guns, each ready to be sold without the benefit of a firearm criminal background check. Without stricter legislation regarding gun control, criminals and violently mentally ill individuals are able to get their hands on what would otherwise be considered to be illegal guns. This lax in law just doesn't make any sense.
Many supporters of the right to bear arms are often quick to play down the need for
gun criminal background checks, mostly because they fear that their lives will be inconvenienced. It is important to remember that the Declaration of Independence and the amendments to gun control laws were written before assault weapons landed in the hands of 15 year olds with a grudge against the classroom. Implementing simple and regular gun background checks through a reputable background check service will not reflect on those that are legally permitted to possess firearms. Background checks before the purchase of a firearm is the only way to prevent the improper use and purchase of firearms in this country.
